Terms of Service

1. Scope and Provider

1.1. These Terms of Service apply to all purchases by consumers via our online shop at shop.serifa.com.

1.2. The provider and contracting party is SERIFA GmbH, Am Hüllfeld 7, 83607 Holzkirchen, Germany, registered with the Commercial Register of the Local Court (Amtsgericht) Munich under HRB 303782, represented by Managing Director Christian Otto, VAT ID: DE456536295, e-mail: hello@serifa.com.

1.3. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside his or her trade, business or profession.

2. Formation of Contract

2.1. The presentation of products in the online shop is not a legally binding offer but a non-binding online catalogue. You can place products in the shopping cart by clicking "Add to cart". By clicking "Buy now" or "Place order with obligation to pay" you submit a binding order for the goods in the cart.

2.2. Immediately after submitting the order, you will receive an automated order receipt by e-mail. This does not yet constitute acceptance. The contract is concluded when we accept your order by sending a shipping confirmation e-mail or by dispatching the goods.

2.3. The contract language is German. Any translations are for information only.

2.4. We do not store the contract text in a manner accessible to you. You can print your order details immediately after submitting the order or access them via your customer account (if available). You will also receive order details in the order receipt and/or shipping confirmation e-mail.

3. Prices and Shipping Costs

3.1. All prices are stated in euros and include the applicable statutory VAT.

3.2. Any shipping costs are shown separately during checkout. Where a product is marked "free shipping", no shipping costs apply.

4. Delivery, Delivery Area, Partial Deliveries

4.1. Delivery times and available delivery areas are shown during checkout. Delivery time information is non-binding unless a fixed date has expressly been agreed.

4.2. We may make partial deliveries where reasonable for you. We bear any additional shipping costs caused by partial deliveries.

5. Payment Methods, Due Date

5.1. The payment methods offered in the shop (e.g. credit card, PayPal, Sofort/Klarna, Apple Pay, Google Pay) are displayed at checkout and processed by the respective payment service provider.

5.2. The purchase price falls due upon conclusion of the contract. Your payment data is transmitted in encrypted form.

6. Retention of Title

6.1. Goods remain our property until paid for in full.

7. Right of Withdrawal (Consumers)

7.1. Consumers have a statutory right of withdrawal. Instructions on withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise your right of withdrawal, you must inform us (SERIFA GmbH, Am Hüllfeld 7, 83607 Holzkirchen, Germany, e-mail: hello@serifa.com) of your decision to withdraw from this contract by means of a clear statement (e.g. by e-mail). To meet the deadline, it is sufficient that you send the notification before the withdrawal period has expired.

7.2. Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day on which we received your notice of withdrawal. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must send back the goods without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

7.3. Exclusions: The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs (e.g. personalized prints). Other statutory exceptions remain unaffected.

7.4. 8. Voluntary Return Policies

8.1. In addition to statutory rights, voluntary return policies (e.g. 30-day returns) may apply as stated in our Refund Policy. Statutory rights, in particular the right of withdrawal, remain unaffected.

9. Transport Damage

9.1. If goods are delivered with obvious transport damage, please complain about such defects to the carrier as soon as possible and contact us immediately. Failure to make a complaint or contact us does not affect your legal claims, but helps us to assert our own claims against the carrier or transport insurer.

10. Statutory Warranty (Defects Liability)

10.1. Statutory warranty rights apply. Any manufacturer warranties remain unaffected and create additional claims against the guarantor.

11. Liability

11.1. We are liable without limitation in cases of intent and gross negligence, for injury to life, limb or health, under the German Product Liability Act and to the extent of any guarantee assumed. In cases of simple negligence of essential contractual obligations (cardinal duties), our liability is limited to the foreseeable, typical damage. Liability is otherwise excluded.

12. Online Dispute Resolution and Consumer Dispute Resolution

12.1. The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/.

12.2. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Copyright

13.1. We retain all copyrights and usage rights to images, motifs, layouts and texts. Any use beyond private or contractually agreed use is not permitted.

14. Final Provisions

14.1. German law applies to the exclusion of the UN Convention on the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain applicable.

14.2. Should individual provisions of these Terms be ineffective, the validity of the remaining provisions shall not be affected.
